Enforceability and statute of limitations for maintenance obligations

Abstract
This study analyzes the legal regime of the enforceability of alimony obligations, with particular emphasis on the distinction between the creation and enforceability of the obligation, the temporal effectiveness of judicial decisions that establish, modify, or extinguish alimony payments, and the issue of the restitution of alimony unduly received. Based on the norms of the Civil Code, in conjunction with the structuring principles of the alimony obligation—namely the principle of the timeliness of alimony and the rule *in praeteritum non vivitur*—the retroactive effectiveness of judicial decisions and their limits are critically examined, especially in cases of reduction or cessation of payments. As a result of the analysis of doctrine and jurisprudence, a general principle of non-restitution of alimony already paid is concluded, based on the welfare nature and existential purpose of the alimony obligation. The regime of prescription of overdue and unpaid payments, as well as the effects of the debtor's default, is also addressed.
