Child support after reaching the age of majority: Legal framework and challenges of application

Abstract

Child support has become an obligation of the parent who does not have custody of the child since 1966 (Decree-Law No. 47344/66, of November 25), which established that this parent is entitled to contribute to the child's upkeep, including food, health expenses, and education – generally in a percentage identical to that of the parent who has custody. This essential mechanism for protecting children assumes the need to ensure their basic needs are met.


Legal responsibility constitutes an essential mechanism for protecting children in the Portuguese legal system, ensuring the satisfaction of their basic needs even after the dissolution of parental relationships.


Law No. 122/2015, of September 1, significantly altered this regime, allowing the obligation to be extended until the age of 25, provided that the beneficiary is in the process of academic or professional training.


Our contribution aims to analyze the doctrine and jurisprudence on this matter, paying particular attention to the difficulties in verifying the conditions for maintaining this obligation, due to the General Data Protection Regulation (GDPR), namely access to the academic information of the adult descendant.


The approaches we intend to take assume a critical perspective on the legislation, not neglecting the effective need to maintain the pension but, without disregarding, the weaknesses of the current regime.
