Abstract
This study analyzes the crime of breach of child support obligation in the Portuguese legal-penal system. It begins with the understanding of the right to child support as an expression of a fundamental right of the child, correlative to a legal-family duty imposed on parents. It examines the legislative evolution, particularly the changes introduced by Law No. 61/2008, of October 30.
It delimits the legal type of crime and identifies its elements. It also analyzes the nature of the crime, the criminal procedure, and the purposes of the applicable sanctions, critically considering the effectiveness of imprisonment and the relevance of alternative coercive mechanisms. It concludes with the need to protect the right to child support as a fundamental legal good, without prejudice to the need for a prudent and proportionate application of penal measures.
