Hematopoietic chimerism and law: The legal challenges of bone marrow transplantation in the genomic era

Abstract

Allogeneic bone marrow transplantation is now a well-established clinical procedure, responsible for curing leukemias, lymphomas, and other hematological pathologies that, until a few decades ago, were fatally incurable. However, the law has followed this progress with manifest negligence. The total or partial replacement of the recipient's genetic profile with that of the donor, a phenomenon that medicine calls hematopoietic chimerism, undermines an assumption upon which the law has uncritically based itself: the uniqueness and stability of DNA as an infallible marker of individual identity. When this assumption fails, so do the legal responses built upon it. This study aims to identify these failures, analyze their concrete consequences in the areas of criminal evidence, the right to identity, and the protection of genetic data, and formulate proposals for normative intervention that the Portuguese legislature can no longer postpone.
