Abstract

It is known that the use of technology has been a reality for decades and that this technological presence tends to continue growing. In the artistic sphere, technology acts as a tool, often essential, for the conception of a work. Regarding artificial intelligence, it is inferred that the copyright holder of a production is the one who, with the help of this software, produced the art. However, how to talk about the intellectual property of something that was produced by autonomous artificial intelligence? How does this interfere in Law? The present research intends, therefore, to propose such questions. The aim is, through this research, to discuss the innovations of artificial intelligence, in order to investigate the impacts of this on Law and on the understanding of what is meant by the expression "intellectual property", understanding how technological evolution requires the improvement of Law and compatibility with contemporary society. Art accompanies life and it is necessary to understand this so that written Law does not become, quoting Ferdinand Lassalle, just another “sheet of paper” that does not correspond to the society that is expressed by the law.
