Are The Loot Boxes Any Gambling? Analysis Of The Monetization Mechanism Present In Video Games Against Brazilian And European Legislation

Abstract
The present research aims to address the structured relationship between the loot box mechanism in electronic games and the social and legal concept of "gambling", emphasizing the notions raised by article 50 of the Brazilian Criminal Misdemeanor Law. In addition, the research aims to ponder the legal repercussions of such themes at national and international levels, highlighting the role of Brazilian and European committees in dealing with loot boxes. Thus, to carry out this scientific analysis, according to the classification of Gustin et al. (2020), the investigation was based on the legal-social methodological aspect. Regarding the generic type of research, the legal-projective type was chosen. Furthermore, the reasoning developed was predominantly dialectical and, regarding the research type, theoretical research was adopted. Finally, the research aims to emphasize the thematic pertinence, emphasizing how a Brazilian legislative treatment must be structured urgently, so that there is a potential for the adoption of protective measures for the various audiences that come in contact with loot boxes and have different rights injured.
